Hiring a Foreign National in Hainan Means Two Permits and Two Authorities
A work permit and a work-type residence permit come from different authorities on different clocks. Hainan has aligned the counters and the validity periods, which helps — provided you know the sequence.

The most common failure in employing a foreign national in China is not a refusal. It is a sequencing error: someone arrives on the wrong basis, starts work before the right permission exists, or lets one of two documents lapse while carefully renewing the other. Two permissions are required, they come from different authorities, and they are not interchangeable — which is the whole of the difficulty and most of the solution.
Two documents, two issuing bodies
A foreign national working in China must obtain both a work permit and a work-type residence permit. In Hainan the work permit is issued by the provincial science and technology department, and the work-type residence permit by the public security exit and entry administration. The province has aligned the process so that both can be applied for and collected at a single service window, with the validity periods of the two documents brought into line — an administrative improvement that removes the most common source of drift, where two documents renewed separately gradually diverge until one expires unnoticed.
The permit and entry rules, as published
- Foreign nationals working in China must hold a work permit and a work-type residence permit. In Hainan the work permit is issued by the provincial science and technology department and the work-type residence permit by the public security exit and entry administration, with both applied for and collected at a single window and their validity periods aligned.

Visa-free entry is not a way to start working
Hainan's visa-free regime is genuinely generous — nationals of 59 countries as published may enter for up to 30 days — and it is the single most misunderstood policy on the island. The published purposes are trade, visits, family visits, medical treatment, exhibitions and sports, and work and study are expressly excluded. The stay is capped at 30 days counted from midnight following entry and confined to Hainan's administrative area.
The pattern this produces is predictable: an executive enters visa-free to look at premises and meet a partner, the trip becomes productive, and they begin doing things that are plainly work. Nothing visible goes wrong at the time. The problem surfaces at the next application, when the entry history is read by someone assessing whether this applicant follows the rules.
Thirty days visa-free is a generous door. It is not a door into employment, and the entry record remembers which one you used.
Immigration status and the tax position are the same conversation
For senior hires the two questions cannot sensibly be separated. The Free Trade Port individual income tax cap requires, in the general case, 183 days of cumulative residence in Hainan, with off-island business travel, leave and training counted provided actual residence does not fall below 90 days. A person's residence pattern therefore determines both whether their permissions remain sound and whether the tax position claimed on their remuneration holds. Recruiting someone on the strength of the tax cap without checking that the role's expected travel pattern supports the day count is a common and avoidable mistake.
What to establish before an offer is made
- That the employing entity is in a position to sponsor, before a start date is promised.
- The entry basis for the candidate's first arrival, and that it is not a visa-free entry from which work is expected to begin.
- The sequence and lead times for the work permit and the work-type residence permit, applied for together.
- Whether the role's expected travel supports 183 days of residence, or at minimum the 90-day floor.
- Renewal dates for both documents held together, since alignment helps only if someone is tracking it.
- Dependants' status, which runs on the principal's and is usually remembered late.
Sequencing a first hire
