Talent Recognition and Professional Credentials

A work permit establishes that someone may work in China. It does not, by itself, reach either of the two status routes Hainan has built on top of that — recognition as high-end or urgently-needed talent, and recognition of an overseas professional qualification for practice within Hainan. Both are separate applications with their own criteria, and both are commonly discovered late, after the executive has already been in post for a year on the standard basis.

Talent recognition is the route that carries a preferential individual income tax position. The criteria look at the individual's role, standing, and the terms of their engagement, and the supporting evidence overlaps heavily with what a work permit application already required — which is exactly why it is worth sequencing the two together rather than assembling the same evidence twice, months apart.

Qualification recognition is the more distinctively Hainan measure, and the one foreign professionals are least likely to know exists. Hainan operates arrangements under which certain overseas professional qualifications can be recognised for practice within the Free Trade Port, in defined fields, rather than requiring the holder to re-qualify domestically. Which fields are covered, and on what terms, is set by the authorities and revised over time — the assessment is always against the arrangements currently in force, and for a given individual the honest answer is sometimes that their field is not within scope.

We assess eligibility for both, prepare and track the applications, and sequence them against the work permit and residence permit so evidence is gathered once. Where recognition supports a preferential tax position, we coordinate with our own tax practice so the status and the filing line up rather than being handled by two parties who never speak.
